Just googled "Nightalker Gameplay Destiny", and watched a bit of the first video until the player used their super.
You can very clearly see that not all the hits used on tethered players are crits.

May have changed then, I'm at work so I can't do hunting now, but I remember seeing several times a hunter shooting a player in the gut and yellow numbers were procing.
