That thread also specifically calls out waivers. They probably acknowledged the issues and applied for waivers with promises it would be fixed in the day one patch, which apparently isn’t uncommon.
Jeff Gerstmann talks about it in the Giant Bomb podcast that went up yesterday. It also just has a good discussion about the game in general. Discussion of the game is after the first few minutes, and the stuff about cert is around the 24:00 mark.
