Smart Delivery is a feature of a game. Like Online multiplayer, it might be something a game offers, or it might not. In this launch Window MS is doing a bunch of stuff to make as many games as possible support it.
My guess is that Microsoft is forcing all developers under their roof to feature Smart Delivery and all other developers have to make the choice. I"m pretty sure all of the games on Game Pass are Smart delivery (Could be wrong). And everything shown at the last Xbox Game convention thing will be on Game Pass.
